Scientology investigated for underpaying workers - ABC News (Australian Broadcasting Corporation)

The Fair Work Ombudsman is investigating the Church of Scientology over allegations it has grossly underpaid staff members.

A number of former employees of the church have told ABC's Lateline they were only paid a few thousand dollars per year for full-time work and had to resort to welfare payments to survive.

Janette Lang, who worked for the church for seven years, says the most she was paid in a year was $3,114 in 2001.

She was second in charge of the Church of Scientology in Canberra at the time.

Ms Lang told Lateline it was "awful".

"Trying to survive as a staff member was a constant battle," she said.

Ms Lang says she had to go on welfare to get by. She says this practice was widespread in the church.

The Church of Scientology declined Lateline's request for an interview, but in a written statement said: "the Church denies any widespread use of welfare by its staff members. Her allegations are unfounded and false."

Lateline has spoken to seven ex-scientologists who say they were on welfare while working full-time for the church.

One former member says she and six other staff members were on the dole while working for Scientology in Melbourne in the 1990s.

Paul Schofield worked for various Scientology organisations in Australia for over 20 years.

He says he had to rely on part-time work and welfare to support his family.

"I didn't even have enough money for petrol to get to work. I had no money for nappies for my daughter," he said.

"I had no money for dog food, yet I was being harassed to come to work and work for nothing."

Tommy Davis, a spokesman for the Church of Scientology in the United States, told ABC's Four Corners in February that staff across the world are paid a living wage.

"General church staff who may work in a church or temple in Sydney or Melbourne or Los Angeles or Cincinnati, wherever it may be in Europe or Asia, they would then have a living wage," he said.

But Dean Detheridge, a former staff member of 17 years standing, denies Mr Davis' claims.

He says he never earned more than $5,000 dollars per year and rarely got holidays.

"In the first 11 years when I was on a full-time schedule I took four days off - they were two weekends and that was difficult to get approval for," he said.

Allegations like these - that are now being investigated by the Fair Work Ombudsman - were prompted by the Four Corners program earlier this year.

'Volunteer' work

Former Scientologists believe the investigation could lead to massive claims for back-pay.

"I personally believe it could bankrupt them," Ms Lang told Lateline.

Ms Lang estimates she could be owed $250,000 in wages. Mr Schofield says his back-pay could be worth $750,000.

Dean Detheridge, who was an executive in the church, says he would have forgone over $1 million in wages.

But the Church of Scientology claims people who sign up to work do so as volunteers.

"Our Church staff are volunteers and understand this and are not helping for the purpose of financial gain," the church said in a written statement.

But the former Scientologists Lateline spoke to deny that all staff are volunteers.

"When I wanted to leave at 2:00 am with my two little girls I was not given the choice to leave," Ms Lang said.

"I would beg to leave and still be told no. There were consequences if you chose to go against what you were being told to do. These people are not volunteers."

Ms Lang and Mr Schofield have given evidence to the Office of the Fair Work Ombudsman. Their investigation continues.

The ABC's Lateline has revealed the Fair Work Ombudsman is investigating the Church of Scientology over allegations it has grossly underpaid staff members.

The Church of Scientology has issued the following revised statement:

The Church of Scientology is, like other religions, staffed by volunteers who do invaluable work helping others. We have previously passed inspections by the Workplace Ombudsman and we are not aware of any current breaches of the Fair Work Act or regulations.

It would be improper to comment on any ongoing investigation until such time as it is completed and we are entitled to fair and impartial treatment under the law.

Australia is a nation well known for its high level of volunteering, with over 5.2 million people over the age of 18 engaging in voluntary work per the last Census figures.

All Church of Scientology staff are religious volunteers and they fully understand that the Church of Scientology operates for the sole purpose of assisting individuals to attain their true spiritual potential through the practice of the Scientology religion.

Scientologists believe that doing service for the Church is a key part of helping others and their own spiritual growth. For this reason many make a spiritual commitment to Scientology and to accomplishing its religious purposes by pledging varying amounts of time in dedicated religious service to the Church. This is not unlike other religious organisations.

Staff members make this pledge of their own free will, solely to help promote the religious goals and tenets of the Scientology religion and the Church itself. They engage in counselling, ministerial work in the community, helping to educate youth on the issue of drugs, human rights and morality.

Volunteers have helped distribute over 2 million anti-drug booklets in the last decade in Australia as an example of the good work they engage in.

Our Church staff are volunteers and understand this and are not helping for the purpose of financial gain. Their generous contribution is warmly valued by the many that they help.

Our Australian volunteers are also very active in disaster response in the Asian and South Pacific regions. They have headed specific relief efforts and supported local agencies in their work with volunteers. Our Scientology volunteers also travelled as far as Haiti to provide assistance most recently after the devastating earthquake there.

Prof. Frank Flinn, Adjunct Professor in Religious Studies at Washington University, who had personal involvement in the religious life as a friar in the Franciscans, compares the religious order of the Church of Scientology with other religions, such as Buddhism and Christianity: "Compared to the practices of many other religious orders, the lifestyle and monetary arrangements in the Church of Scientology are, if anything, generous".

Contrary to Ms Lang's claim, the Church denies any widespread use of welfare by its staff members. Her allegations are unfounded and false.

Ms Lang left Church staff over seven years ago now and we cannot comment on Ms Lang's personal lifestyle or choices. However, some of her former fellow Church staff attest to her having an adequate private income that she and her husband lived on when they knew her on staff.

Ms Lang was well aware that she was a religious volunteer and she agreed to the following during her time on Church staff and also encouraged others to volunteer for the Church agreeing to a religious commitment as follows:

"I FURTHER UNDERSTAND THAT ALL CHURCH STAFF MEMBERS INCLUDING MYSELF, ARE MEMBERS OF A RELIGIOUS ORDER; THAT THEY SERVE PURSUANT TO THEIR RELIGIOUS OBLIGATIONS AND NOT IN CONTEMPLATION OF RECEIVING ANY COMPENSATION WHATSOEVER, AND IN DOING SO, THAT THEY ARE FORSAKING ALL COMMERCIAL AND FINANCIAL MOTIVATION."

The Church of Scientology continues to offer social programs and services with the invaluable and dedicated work of our volunteers who are greatly admired and appreciated by Scientologists and others across Australia.

In the United States there are three factors taken into account to determine if someone is an employee or not

Facts that provide evidence of the degree of control and independence fall into three categories:

1. Behavioral: Does the company control or have the right to control what the worker does and how the worker does his or her job?
2. Financial: Are the business aspects of the worker’s job controlled by the payer? (these include things like how worker is paid, whether expenses are reimbursed, who provides tools/supplies, etc.)
3. Type of Relationship: Are there written contracts or employee type benefits (i.e. pension plan, insurance, vacation pay, etc.)? Will the relationship continue and is the work performed a key aspect of the business?

How does australia determine if someone is an employee or a volunteer?

AFAIK the law on volunteers varies from state to state (based from a quick austlii search) as of yet I can't quite find anything related to volunteers except ones to do with the emergency services.

Incidentally, I stumbled upon an old piece of news last May 31st, quoting a policy by Hubbard to take advantage of Government welfare by staff members:

... In a further document, entitled HCO Policy Letter of October 6, 1970, Issue II, Personnel Series No. 10, MOONLIGHTING, the organization says "Moonlighting on the government would be quite permissable. With governments anxious to hand out welfare, in some depressed areas it would be quite all right to go on the dole or relief and work as a church volunteer in the org. (anization). Org Staffs under such duress can even live as monasteries for food shelter and pocket money. . ." ...

Sure they may have signed a document saying they were volunteers but the obvious question the ombudsman must be asking is were they treated like volunteers or more like employees?

Volunteers cannot be required to keep a work schedule, 9 - 5 for instance, they can come and go as they please.

Volunteers do not need permission to take vacations.

Volunteers do not have to adhere to extraneous codes of conduct such as required staff reading, saluting etc.

Volunteers are only compensated for their out of pocket expenses.

Volunteers are never referred to as employees.

Any evidence contrary to the above should be enough to class them as employees from a practical point of view regardless of the mumbo jumbo they might have signed in their misguided youth because you cannot volunteer for an agency that is employing you no matter how the contract is worded.

The ombudsman needs to be pretty shrewd though not to get confused by the legal smoke screen the scilons will fire at him though.

Hentlemen,

As we know, the Scientologists are (gasp) lying their siphons off about staff work being "volunteer work." As we also know, the help wanted scam is global. It might be useful to have a bunch of pix from all over the world showing their "help wanted" signs that appear to offer EMPLOYMENT, not volunteer positions. Perhaps Latenight could use them in a followup programme to demonstrate how the cult misleads passersby into applying for "jobs" that don't exist.

They just deny that it was "widespread". Though they should explain then imho how it comes that some staff members weren't paid a living wage, while all others according to them were.

I would be interested to know how many "volunteers" in the US ended up on government assistance of some sort. Wether it be Food Stamps in the past, welfare, ect....

"The COS in Lakeview is on Lincoln near Wellington and Southport. It has the customary blue Scientology awning, but also has a window display facing the street that features pumpkins, Thanksgiving decorations and other 'normal' stuff. A sign near the entrance says "Help Wanted; Now Hiring."
