‘Review of not-for-profit governance arrangements’

The Government announced in the 2011-12 Budget a number of further reviews of aspects of the regulation of the NFP sector, including a review of the governance obligations appropriate for not-for-profit entities. The Government has today released a consultation paper to help determine what the core organisational governance principles applying to registered NFPs should be. The consultation paper provides an opportunity for the NFP sector and the wider public to engage on this issue. Attached is a factsheet which outlines some key facts and frequently asked questions. The Consultation Paper is available from Treasury’s NFP reform website at treasury. We would also be happy to discuss any issues which you may have in this area.

Please note that submissions on the consultation paper close on 6 January 2012. Treasury recognises that this is a very tight timeframe, however, the outcomes of the governance review will be included in the governance requirements for registered entities in the ACNC legislation, starting from 1 July 2012. In order to have the ACNC in place and up and running by 1 July 2012, legislation for the ACNC needs to be ready to be introduced into Parliament in the first quarter of 2012.

This consultation builds on previous consultation undertaken by the Government on a not-for-profit regulator, as part of the Scoping Study for a National Not-for-profit Regulator.

Summary of Submissions
The ACNC Taskforce released a Discussion Paper (9 December 2011 to 27 February 2012) on the proposed operations of the ACNC and received 121 submissions. The taskforce is reviewing the submission and will publish a response to these submissions in late April. In the interim a Submissions Summary has been developed.

ACNC extended start date
The recent press release announcing the extended start date of the Australian Charities and Not-for-Profits Commission to 1 October 2012 will allow further consultation with the sector on the exposure draft of the ACNC Bill. It will also allow the Implementation Taskforce more time to prepare and distribute guidance material to assist charities in the transitional period.

Some churches 'run more like cults'

INVESTIGATORS with the new Australian Charities and Not-for-profits Commission are probing numerous alleged breaches, including serious fraud and misleading behaviour, in a historic clean-out of non-compliant charities.

The ACNC, established in December, has set up a team staffed by experienced former law-enforcement officers, auditors and risk managers to investigate complaints.

Andrew Sealey, director of strategic intelligence and compliance, said the ACNC had received 62 referrals from the public and other regulatory bodies and 25 investigations were still open.

Speaking of Narconons - has there been an organised protest against the NN in Melbourne yet?

It would be great if we can organise one. I'm happy to come out there and bring a few Sydanons - have a campervan to use. Caek and party for all.
