    I think you may have nailed it on the head. The Public Harm/Public Benefit is what needs to be shown and Exposed.

    And we ALL know there is a lot of harm.

    Well, it will go to senate committee, where there'll be public submissions...and they'll make sure the rules don't create "false positives" (i.e. legitimate charities being excluded)...issues of how to measure public benefit will probably be examined - Like developing a criteria and the types of evidence an organization has to show to continue getting not-for-profit status.

    But assuming a bill is passed, the body who will enforce it will be the ATO (Australian Tax Office). The one thing I'm unsure about is who exactly will be assessing whether entities meet the criteria for tax-exemption or not. Could be a department in the ATO, in which case the funding would be part of their internal budgeting...and quite possibly the onus could be on applicant to prove they're entitled, rather than the ATO doing the majority of the legwork.

    Contentious/suspicious claims would probably then go in the "we need to independently verify this" basket (much smaller group than assessing everyone).

    For Scientology, the "public benefit test" may not be enough in and of itself, however, if passed would give a legislative basis for challenging their tax-exemption (so that could either be a gov. department/ATO deciding that, or another parliamentary inquiry to see if they are in violation of the new rules, or possibly challenged through the courts).

    But this is ALL speculation and based on my limited knowledge of these matters, so someone else may be able to provide better info. Anyway I imagine the ATO may give evidence at an inquiry about the administration side of things...and this'll be broadcast over the internet. I'll keep an eye/ear out for these issues.

    This would also be good to hit on the local/state/federal levels in the U.S.

    Put poons into your local papers, stating the particulars of the UK "public benefit/public harm test", how it's being considered in OZ, and how (while staying religion neutral), it would be a good idea in the states.

    DO NOT tie it into Scientology - use the same "public trust" arguments that Senator Xenophon used.

    If it's spread enough, the Sci's can be hit from a hundred different localities, at several different levels, all asking for the same "public benefit/public harm" test. Every time they try to state the good works of one of their charities, we can fire back with a "yes, but would this charity pass a 'public benefit/public harm' test?"

    tl;dr COSRECI looses charity status but its "charitable" subsidiaries such as "NarCONon", will be unaffected, totally agree.

    This is why there also needs to be tough auditing of the accounts of charities to ensure monies are spent and not simply being transferred to a related non charity entity in a tax haven.

    Such practices as paying license fees (for "tech", use of trade marks etc.) should be outlawed if those fees make up more than a 0.5% portion of their off set expenses.

    The costs of consumables should be looked at too, i.e. training materials. Those should be obtained from in country suppliers which are taxable.

    Consultancy and administration expenses should also be looked at carefully too, though these naturally make up a lot of the expenses of charities anyway, more so the administration costs.

    Basically if the charity recruiting fronts cannot be neutralised through education of the public and service commissioners then it should be such that it has to run a very tight ship financially to limit its ability to efficiently pass tax free funds back to the mother [STRIKE]ship[/STRIKE] [STRIKE]church[/STRIKE] cult.

    These are tough times financially the world over and such measures are necessary to reign in the public purse strings.

    Thank you very much for this.     Quite notably, he uses the word "religious" over and over again and this is where their Power is established. Governments will not go near this defence unless there is a Hate Crime or something to do with Terrorism.

    Australia is going about this the correct way. They are staying away from the "religious" aspect, and seeking to protect the public from ANY organization who has Charitable Status, but does not contribute to the betterment of ALL it's Citizens.

    David Micavige denies, denies, denies, over and over again and points blame to the Secret Operations of the Gaudian Office; which he must do to protect Scientology as a whole. Many times, I have read similar cases where statements were made by other members, such as, "....you can't condemn the entire organization, for the mistakes or acts of a few....?" Well in my opinion, it's not just a few; it is many.

    So now the GO has been renamed OSA, with no more Fair Gaming?

    When the "Source", (Hubbard) declared, ".....make money, make more money, bring more people in to make more money, (paraphrased), it hardly seems to me that "make money" equates to helping people, (especially a Wog, as I was called), contribute to the society or Country they live in.

    I my view, the "religous" word, is only a coat of armour to protect and fend off attacks from any source confronting them. I wonder who the next "fall guy" or group within the Group will be used as a "Scapegoat" for their withering Survival.

    "The Commissioners having considered the full legal and factual case put to them by CoS, and having reviewed the relevant law, taking into account the principles embodied in ECHR where appropriate, decided that CoS was not established for charitable purposes or for the public benefit and was therefore not registrable as a charity under section 3(2) of the Charities Act 1993.

    In making that determination the Commissioners further concluded as follows:

    1.That CoS is not charitable as an organisation established for the charitable purpose of the advancement of religion because, having regard to the relevant law and evidence, Scientology is not a religion for the purposes of English charity law.

    a.The Commissioners considered that the legal authorities establishing the meaning of religion in charity law were ambiguous, but having construed such authorities in a way compatible with ECHR they concluded that the definition of religion was characterised by a belief in a supreme being and an expression of belief in that supreme being through worship.     b.The Commissioners decided that the concept of a supreme being was broader than the theistic concept of a personal creator god, but otherwise it would not be proper to specify the precise nature of that concept or require it to be analogous to the deity or supreme being of any particular religion. However the Commissioners did not find themselves compelled to reject the concept of theism altogether nor to accept the abstract concept of the notion of a supernatural thing or principle.

    The Commissioners concluded that Scientology believed in a supreme being.

    c.The Commissioners decided that the criterion of worship would be met where the belief in a supreme being found its expression in conduct indicative of reverence or veneration for the supreme being. R v Registrar General ex parte Segerdal [1970] 2QB, 697 Winn LJ at p. 709A. It was not possible to worship an ethical or philosophical ideal with reverence. Re South Place Ethical Society, Dillon J at p.1573A. Worship may manifest itself in particular activities which might include acts of submission, veneration, praise, thanksgiving, prayer or intercession. R v Registrar General ex parte Segerdal, Buckley LJ at p. 709 F-G. The Commissioners having considered the activities of auditing and training, which Scientology regards as its worship, concluded that auditing is more akin to therapy or counselling and training more akin to study and that both auditing and training are not in their essence exhibitions of reverence paid to a supreme being and such Scientology practices are not worship for the purposes of charity law. "

    Yes, and no, about Buddhism. It depends on the branch of Buddhism, and even in the versions that do not believe in a supreme being, they do express a reverence for Siddhartha Gautama that equates well with worship and seek enlightenment. This can be contrasted with the Church of Scientology, in which you see none of this.

    Because Ruddkipz is haemorrhaging support thanks to his endless fail and needs some blackup. Xenophon has a habit of holding the balance of power in the upper house, along with the greens.

    So... will COS push the VM's PR even more so now?
    If so, are they any ex's out there that were part of the VM's that can debunk the VM's agenda?
    I know a while back Pooks (I think it was) said the first thing the VM's do when they get to a disater site is set up a board and take PR pictures. Also handing out other people's donations and pushing pamphlets or books on people.

    The booklets are a good money scam. They cost 14 cents to print in bulk (leaked ABLE docs for that) and 7 cents royalty per booklet goes to the "L. Ron Hubbard Library", a fictitious business name for the Church of Spiritual Technology.

    So (after 10% has been scraped off gross income and sent to ABLE), a third of the booklet donation money goes uplines to the top of the pyramid.

    This is assuming that they actually print any booklets. (The claimed numbers are usually like a 5 year bum-wipe supply for the region targeted.)
