Then she defends Criminon - something she has pushed for - by accusing its critics of religious bigotry, and immediately reaches for the Freedom of Religion card. Now she's sending out C&D letters to censor something that was publicly available and on her own fucking website? If I didn't already know she was a batshit insane fundie, I would say that she's a dead ringer for a Scilon. Pretty much everything she's done in her PR campaign has been straight out of the LRH playbook. If she's not a Scilon, then someone in her campaign is.

The fair use copyright infringement defense is not necessarily unavailable in cases where the infringement is of an entire protected work. However, cases where such uses have been upheld are rare. That four part test is based on the nature of the work, the purpose and character of the use of the work by the accused infringer, the effect upon the work's value, and the amount and substantiality of the copying. In this case, the final factor obviously weighs heavily against Reid's use. He has copied the entire thing. This factor often comes into play in cases like rap music sampling, where someone has sampled 3 seconds of some song and looped it, but that's the most recognizable part of the song, i.e. what is called "the heart of the work." Obviously, when you copy the whole work, this factor weighs heavily against you. But Reid isn't out of luck. The effect upon the work's value is nil, since it basically has no commercial worth whatsoever. Sharron Angle is not selling access to her website. It is a form of political advertising intended for broad dissemination. Angle has now decided that her previous, insane positions, which catered to her base of the time, are no longer politically convenient. This does not imbue them with any independent commercial value. This factor is on Reid's side. Angle should only be entitled to statutory damages, if anything, since she has not been commercially damaged. Similarly, the purpose and character of Reid's use is for political speech, the most highly protected of all First Amendment speech. The context is a federal election. It would be hard to imagine how this factor does not weigh heavily in Reid's favor. Finally, there's the nature of the work. Fitting in with the effect upon the work's value, generally the primary factor in a fair use analysis, the work is one which was intended for the greatest possible dissemination, free of charge, to benefit Sharron Angle in the primary campaign and get her votes. This factor favors Reid. The fact that the case is actually somewhat analytically complex favors Reid, and this is why my response, if I were Reid, would be very simple: "Go fuck yourself." This is why. While the case could, conceivably, end up in Angle winning, it would be months or years in the future. Meanwhile, the damage to Angle from actually filing such a suit would be immediate and permanent, and virtually guarantee that the material Angle is attempting to suppress will get the widest possible dissemination. Even if Angle got a restraining order, independent bloggers, many of them overseas, would then mirror the offending material, and anyone who wanted to see it would. It is simply technically impossible to remove content from the Internet that people want to see. Therefore, if I were Reid, I would go out of my way to taunt Angle and her idiot lawyers into committing political suicide and losing the election with a foolish and ill-considered lawsuit which, while possibly founded in good law, which on its face favors Angle, would in reality result in immediate, incredibly adverse results for Angle. Napoleon is quoted as saying "Never interrupt your enemy when he is making a mistake." I have a corollary to that, which is taunt your enemy into making a mistake he is threatening to commit. tl;dr Angle may have the law on her side, but Reid has a good defense. Regardless, Angle will commit political suicide if she files this lawsuit.

I'd be very very interested how this would argue out if 1) if it ever were to be argued in court and 2) if it whatever decision were to be appealed. In the meantime, she seems to be following the scientology playbook to a "t" and you are right, it will only get better if HR continues to mock her - lets all hope for more footbullets and lulz.

Re: Sharron Angle sends cease and desist letter to Harry Reid I don't find much to disagree with regarding your fair use analysis, but it seems highly unlikely that this dispute will be litigated. For every thousand cease and desist letters there's maybe one lawsuit filed, and the vast majority of lawsuits that are filed settle. One factor making a lawsuit even less likely is the absence of a profit motive--money isn't directly at stake, and both sides would be spending lots of campaign dollars to take a principled, and likely pyrrhic, legal stand (Angle wouldn't be the only one whose appearance would be damaged by an expensive lawsuit). Moreover, there are a multitude of ways (less costly than litigation) to present the original context of Sharron Angle's website that would moot all questions of infringement. Also, if Angle went to court to seek a preliminary injunction, the key legal question would not be whether Reid is liable for infringement (a question that might ultimately favor Reid), but rather whether the harm to Angle if the injunction is denied outweighs the harm to Reid if the injunction is granted (along with the likelihood that Angle would succeed on the merits). Courts tend to err on the safe side and favor plaintiffs in such instances. Whether the Court would ultimately decide for Reid is somewhat irrelevant due to the dated content (by the time Reid "won" the election could already be resolved--and Angle will have achieved her goal). It's also worth noting that the cease & desist letter doesn't allege only copyright infringement, but speaks vaguely about misappropriation and 'likeness'--the c&d cuts across many areas of IP law, including trademark, copyright, right of publicity, a misappropriation tort, etc. A fair use analysis would be inapplicable with regard to some of those possible claims. It appears that Reid has backed off at least for now because the site I'm looking at is definitely not a older/cached version of Angle's site, but this means that my above comments are based on the descriptions given here of it and not by having viewed it. Another interesting thing about the cease & desist letter is its claim that Reid used the interactive function of her website to capture names and email addresses of people who would presumably sign up for Angle's old site not realizing it was Reid's. The functionality of such a form would not carry over to a new domain without having first been recoded, and it seems doubtful that Reid [i.e., his campaign] would have done that. But it would give rise to a definite cause of action if he/it did.

The original site was apparently a complete copy where as the new site is much more in keeping with the illustrative copyright exemption provisions.

It was a bit dumb of Reid's campaign to simply put up a copy of the original without making it obvious that it was a Reid site, if that's what they did.
