(This document follows the July 18th 2006 hearing where the accused was declared non criminally responsible because of mental illness. He was charged with 2 counts of criminal harassment as well as breaking and entering in a criminal intent in 2005 and 2006.

The accused was complaining of noises coming from his neighbor’s appartment. He broke into the appartment of one of his female neighbors. He had bought a stone or ceramic ball to bother his neighbors. He threatened the concierge, the other victim, to commit a murder because of the noises. He continually harrassed both victims, complaining and threatening them.)

The man is 45 years old, single and without children.

Relevant prior events

The man was evaluated at the Montreal Prevention Center in August 1985 when he was under the care of Dr Wolwertz. No sustained hospitalization was previously reported.

It is noted that at the time, in 1985, the man had presented aggressive behavior toward his sister because she had, according to him, made disparaging comments about him. The man explains that he was transferred from the Detention Center of Sainte-Hyacinthe (south of Montreal) to Parthenais Prison (in Montreal) because he was in need of hashich and he wanted "to be drugged". After meeting with Dr Wolwertz at Parthenais, he was put in isolation. He was threatened to receive an injection. He was prescribed 100 mg of Largactil, four times a day, for about a month and a half. This made him uncomfortable, getting him agitated.

He then spent time at the Drummondville Courthouse (southeast of Montreal), where he got his sentence that he then served at Bordeaux prison in Montreal. Immediately after his release, he went to the Church of Scientology, where there is a very virulent, antipsychiatry movement that preaches abstinence from medication and where people are angry at psychiatrists who prescribe psychotropic drugs…

The man filed a complaint against Dr Wolwertz to the Citizen’s Commission. He went to the office of Dr Wolwertz armed with a long knife on which was written the following (original text in english) : "Don’t play with my reactive mine" (mine and not mind in the original text). He attacked Dr Wolvertz in the parking lot. He was angry at him. He wanted him harm. He stopped when he saw the doctor run away, screaming. He imagined plunging his knife into the doctor’s heart… He felt great discomfort… He didn’t understand why he was accused of attempted murder, at the time, because he didn’t kill the doctor, he stopped before even trying to kill him… He should have, instead, been charged with assault…

Nevertheless, he was sentenced to nine years in prison. He spent 6 years and 10 months in prison.

(The following text describes the man’s psychiatric history after his prison term. From the ‘90s to 2006, the man exhibits aggressive and vindictive behavior, a troubled sexual behavior and a "massive investment in Scientology and Dianetics", that doctors find excessive. He was also asked by his parents not to discuss Scientology too much because it bothered people. It is not demonstrated nor mentioned if the man attends a Scientology Org, group or if he does scientology on his own. He’s on social welfare.)
